I was added onto my ex-husbands account when we were married. When we divorced, I tried taking my name off the account but they said they can only take it off if the primary goes in and takes my name off since he is the primary holder of the account. He told me he had already taken my name off after I had asked him to. 4 years after our divorce, I get a phone call saying that my name was never taken off the account. I'm having a hard time trying to get him to take me off the account, not only that he has been over drafting in this account, and it's bringing my credit down. If I wanted to sue him for never taking my name off the account as he had told me, under what law can I sue him?

My thought, somewhat silly, next time there is money in it, go take it out, it is not theft since your name is on the account And I bet he will meet you at the bank to take your name off it, when that is the only way you give him the money back

I would assume you are a signer on the account, not a owner, if you are a owner of the account, go in and close the entire account out to get your name off.

And why was this not addressed in the divorce
