Hi I have a question. I live in Maine.
I am being sued for an outrageous amount by capital one. The original debt was said to be $2200 but the total with interest and fees is well over $11,000.
When I received the papers I filed a validation request, a letter of denial and a letter of discovery. They then filed an extension. They filed another extension and with it they filed a letter of discovery. I filed an extenstion. The extension for 90 days was granted in December to Capital One. I assumed (I guess wrongfully) that the extension was also for me which would give me 90 days from January. I haven't heard if it was approved or denied or thrown out (my extension).
Anyway they now filed paperwork stating I didn't answer my discovery questions so therefore they should win because they assume all information is true since I didn't answer the discovery questions.
Now what? Should I go to the clerks and see if my extension was granted or denied? Again I haven't heard from the judge if it was or wasn't. If it was denied or ignored or thrown out and I didn't answer the discovery questions (thinking I had 90 days) is it to late? Can I ask that this be taken to trial? If so do I answer the discovery questions then ask this being taken to court then? Or do I ask if this can go to court and not answer the discovery questions. And what do I search under or where do I look for how to request it be taken to court. Furthermore there discovery answers were vague and they objected to a lot of them saying the information was irrelevant. A lot has been going on I may have missed the deadline. I was just laid off, just found out I have precancerous cells that need to be removed and have a test to see how invasive the cancer is on Monday. I'm sure stress is not an excuse for not answering the discovery questions. So anyone have any ideas?
