View Full Version : Child support for disabled son who is now 20 years-old

I have a 20 year old mentally handicapped son. His composite IQ is 66. He is currently a full-time student in high school in an EMH (Educable Mentally Handicapped) program. By law, he can stay in school until his 22nd birthday. We reside in Florida.

His father lives in California and does nothing at all to help care for his son. He stopped child support when our son turned 19. The court order said 18, however, I told him as long as our son was a full-time student I was sure a court would order him to continue and so he did. But once our son turned 19, support stopped completely. Can I go back to court and be awarded back child support or support going forward? He is unable to live on his own or care for himself, so I see him needing full-time care for the rest of his life.

Any help would be greatly appreciated.

Have you looked into getting him on Social Security Disability? This would not end regardless of how old he gets.

You could take it back to court nut this should have been addressed long ago. I agree with seeking SSD for him and also you might call out to Calif and ask for an opinion. Most extensions for reason of disability are there for extrodinary expenses. Also to extend medical benefits too.
