Hello,

My husband and I are renting a property with the option to buy after one yr. Well we were notified by the owner that they decided not to short sale the house to us and are now proceeding with Deed In Lieu, which means they are deeding the house to the bank in lieu of foreclosure. We put $7000.00 down on this house to go toward the purchase of the house at the end of our 1yr lease agreement, and since the owner broke the option agreement, has agreed to pay us back but not immediately because they are not finanically capable at this time. They agreed to pay us back in 5-6 months, but also emailed us a 60 day noticed that was not signed nor dated. So the request is for us to be out of the house in sixty days because the bank won't allow the deed in-lieu if the house is not vacant. So my question is, what are our rights (my husband and I), and doesn't the 60 day notice need to be signed and dated. Are we to go based on the email, date?

Please help

Someone will correct me if I am wrong, but I do not believe email is considered legal notice. It has to be in writing... meaning paper.
