Can I be paid by taking the number of yearly hours I am contracted for by my employer which is 1040 by the hourly wage of $7.22 then divided by 24 because I am paid biweekly. I never work overtime. This would give me the same amount in each bi-weekly check. I work irregular hours but when totaled for the year they add up to the 1040 hours which I am contracted for.

If you are salaried exempt and are paid a salary iinstead of an hourly wage than you can be paid the Annual wage divided by the amount of pay periods in the year.

If you are hourly non exempt no you cannot be paid this way. Each week is on it's own 40 hour standard. If you work over 40 hours you are paid overtime, if not you are paid for the hours in the week which you work.
