View Full Version : Eviction in FL - Need Suggestions for a very complicated situation

I signed a 1 year lease with my boyfriend in Dec 08. Things quickly went very bad and I was facing verbal & physical abuse and had to have him "temporarily" removed from the premises at the end of January. He was also taking my car without permission, driving without a license (I didn't want him driving it after I happened to find that out - after he got a ticket)!

The night the police removed him from the house we were renting they told me the best and safest thing I could do was to move and move as far away as I can... they told me that because we were both on the rental agreement that I could not and they could not make him leave permanently... he didn't even stay gone the 24 hours, he came right back as soon as he left the police station. This time with actual threats to do me bodily harm and even told others.

So, I took it seriously and moved out, unaware to him one day when I knew he would be gone all day & moved back to my home state.

From my understanding, my ex-boyfriend and the landlord have been in contact with each other because he's had difficulty covering the February & now March rent. He made arrangements for February but understand that he couldn't pay March (this coming from him). Evidently, the realty company is now invoking their right to evict for non-payment so he is telling me.

However, I have not received any type of notice from the realty company verbal or written and they do have my "home address" in my home state because when I rented the house, I let them know that I do own a home, it was on my application and on my drivers license. They also have my cell phone number...

What should I do? Evidently, they know that I have removed myself from the property because he's been in contact with them... I'm not sure if I should contact the real estate office to see what's going on or if that will just make things worse.

One more piece of information, the neighbors have been complaining about him - not sure what that entails but I think one of them had the sheriff visit him for harassing her... just hearsay... However, he's spent the night in jail a couple times since I left for similar harassment/fighting incidents.

Any suggestions on how to handle, is there anything I might need to do? Or just let sleeping dogs lay?

You need to monitor the eviction. They will have file the eviction against both of you since you are both signed on the lease. They CAN hold you responsible for the unpaid rent up to the date of the eviction.

Whether they will or not, I don't know.

By the way its not that complicated a situation. However, what you should have done is try to get a restraining order against him.
