Hi,
I am a Indian Citizen and my wife is a Mexican citizen. We got married here in the US 3 years ago while I was on my F1-student Visa and she on her B2 Visa. My current employer had applied for my H1B in 2008 and I received my approval in Oct 2008. I do not know the reason, but he had refused to apply for my wife's dependent VISA along with my H1B application. Now I wish to apply for an H-4 visa for my wife. From what I have read so far we need to fillout DS156 along with supporting documents to apply for the H-4 VISA. I have not gone for my H1 stamping yet. What is the best option in our case?
1. We can file the DS156 with a local USCIS office and wait for her H-4 approval. Then we both travel to mexico and have our VISA's stamped together.
2. I should travel first to have my VISA stamped and then apply for her dependent VISA.
Any help or recommendation will be appreciated.
