I was married 5 years ago and unfortunately we were only together for 1 month here in the us ,he moved back to france and I stayed here we know want to get a divorce but are not sure of the legalities can I start the divorce here and have him served via fed ex for signiture?do I have to go to a judge and have him sign the paperwork before or after I obtain a signature from him? Does he need to be present at the time of hearing. Is there a hearing? I may sound nieve but I am not clear on a regular divorce let alone a international one. He never received a green card nor did he apply for one. Therefore he is and has always been a europeian citizen. He was on a working visa when we married.thanks for your web site I hope you can help me out. Also were do I go for the proper paperwork and do you know what the cost may be for the complete divorce. When would the actual divorce be finalized?

If you were married in the US, and lived here together the time you were together, yes you can file for divorce here in the US.

If you and your soon to be ex can agree on the terms of the divorce, you have your attorney write up a divorce agreement, your attorney will send him a copy for him to sign it.

He returns it and you submit it to the judge who would normally sign it.
