View Full Version : Adding a non-biological father to birth certificate in Maryland

Info needed to know:My son is almost 12 yrs old, his real father wanted nothing to do with him ever. I moved to another state when he was 1. I meet my husband when my son was 3 yrs old, been calling him Dad since then( my son knows of his bio-dad and has meet him again at 10yrs old).We know have been together for 8 yrs & 2 children together There is NO fathers name on his birth certificate. My husband wants put his name on his birth certificate, wants full responsibility of him.
:confused:Now my questions are Since he was born in another state(NC) do I get info from there or can I add his name in this state(MD)? Can I get in trouble for him signing this? What forms would I need?
If anyone could help I would be so grateful!:) Thanks again

I was born in California and my birth dad was removed from my birth certificate; and my step dad added since he raised me. That was a good 20 years ago. But we got it changed in Idaho, just went before a judge. Im not sure if its still the same in all states. Hope it helps.

You can do it where you live. Its called adoption. Your husband is going to have to go through the step parent adoption process, which includes the bio father having paternity established and him signing legal rights away. The fact that his name is not on the birth certificate actually makes it more difficult, not less.

Get a family law lawyer. It shouldn't be too difficult of a process.

You more then likely are going to need a court order to make any changes at all to the original birth certificate. Any changes to it will have to do with NC. Should your husband want to adopt you can take care of those matters in the court of your home state. The birth certificate is a separate issue because it's a legal document and not something that you own and control. SO your going to have a battle on 2 fronts. 1) for custody of the child.. and 2) for the change on the birth certificate.

Your best off asking NC what its going to take so you can make the right presentation when the time comes.
