Hi,

I joined this community today and thought to get more information about claiming tax refund for dependents.

I am a citizen of India and presently working in US on J-1 research scholar visa since September 2007. I am married and my wife is dependent on me (J-2 visa).

Last year for filing 2007 tax return, I used Cintax software and I was directed to use 1040-NR-EZ in which I claimed only Exemption of $3,400 as directed by software. Very recently, while attending a Tax workshop I realised that as a part of US-India Tax treaty, I could also ask for Standard deduction which I did not ask for 2007 forms.

What is the solution to this situation now? Can I amend this changes for 2007 tax return? I guess this would help me to get some refund based on std deduction and exemption.

I would appreciate any feedback to this issue.

Assuming that you are in fact subject to income taxes (J-1 researchers CAN be exempt from all income taxes for the first 24 months in country), you need to amend your return using Form 1040X and attaching an amended Form 1040NR-EZ.
