View Full Version : 1042-S form and H4 Visa holder

I got 1042-S from my university. They treated my scholarship/grant excess to tuition fees as income. Hence Box 2 shows $5568 and at 14%, Box 7 shows 780 Tax.
I know that I need to complete a Federal tax return in order to apply for the refund of the taxes that were withheld from the scholarship/grant that I received.
However, I hold H4 VISA (my mother is a H1B holder). I know that H4 holder is not allowed to work in the USA. I am not sure whether I can file a return with the income from SCHOLARSHIP/GRANT so that I can claim the money back based on my income.

Do you have SSN? If yes, file your tax return.
If you do not have SSN and can not get it, then attach W7 (ITIN application) with your tax return.

Yes, I have a ITIN. So what you mean is that I can file my tax return with some income from scholarship/grant even I hold H4 VISA. Wish to get your answer again.

If you have not yet filed, do so. The IRS will recognize the income for what it is (taxable grant/fellowship/scholarship money) and NOT earned income.

Hi, storepaper123! I am an h1-b visa holder and my husband is studying under the RN program in a community college. Soon, my senior daughter is going to be in college. It's so hard to pay tuition and buy books from our family budget since I am the only one working. Then I stumbled upon your post about your scholarship/grant. I'd like toask how you were able to avail of your scholarship/grant? It would be a great help for our family if my husband and my daughter can also have scholarship/grant. Any input would be truly appreciated. Thanks.

Apply for scholarships and grants through the Financiual Aid Office at the university. That is your best source of such grants, and you know it is legitimate. There are a LOT of scams out there, so be careful.
