View Full Version : DO H4 visa holders need ITIN ? Do the dependent need to sign the form 1040EZ

Hi ,

I have a question ,Would be very thankful if somebody could answer me .

I got married to a H1B holder in USA in last year ,but due to some differences I did not accompany him ever.I mean I have not been to US any time .

He sayd he is not interested in me and would like to get divorce from me .

Recently he emailed me asking to sign some W7 form ,1040EZ and send to him .
I do ot understand though I am not there in USA why does he need my sign ,and why do I need ITIN number .

If at all I sign and send him ,will there be any problem for me ?

Also can't he submit taxes for himself,why does he need my sign ,he says he cannot submit taxes without my signature in the form 1040EZ .

If you sign ITIN form and tax return, he will get extra deduction of $8,950 (or even more) so he will have bigger tax refund.

Also you agree to be treated as U.S. resident for all the year and you must report your worldwide income for the year. You are jointly responsible for any error, mistake or wrong information on the tax form. If he owes taxes, you are also responsible.

Thanks a lot for your spontaneous response.

But what if I sign and send only ITIN form and not the 1040ez form?

So is there any chance that he might misuse my signature .

What sort of problems would I get ?

Sorry.. I have missed one thing .

Can't he submit taxes for himself ?Is it mandatory for the wife's sign.

When you file as married filing separately, you do not need spouse's ITIN if the spouse is nonresident. You can always write N R A in place of SSN or ITIN.
When you file joint return, both must sign the return and put their SSN or ITIN.

Hi MukatA,

If he submits the taxes as married filing separately ,then do I also need to submit the tax returns as married filing separately for myself.

Though I am not living in US ,do I need to submit my taxes ?

I am not clear on this. Let me know .

No, unless your U.S. income is more than $3,500.
