View Full Version : How long before child abandonment can be filed in TN?

My sister got has a six month old son with her ex boyfriend. About a month and a half ago he decided to move to Florida to be closer to family, however he has lived in TN for about 3 yrs. Their son was born 6 months ago, and they lived with him in a rental home which he has been evicted from. She moved back in with our parents, and he took all their tax money and went to Florida. He calls her from time to time, but never sends any money to help with diapers or formula. My question is, how long does she have to wait before she can file abandonment charges against him and have full rights? He accidentily hit his phone the other night and called her number while in the process of buying prescription drugs with their money, and has a felony charge for which he has spent time in prison. Hes a real class act. Thank you for your help

She can file for "full rights" that is both legal and physical custody.
The father can always still ask for visitation.

Is there a child support order in place ? If not, he is not even late with support,

And of course one could ask if he is such a act what she say in him, but anyway, She can use the fact he left with the money and file for custody.
