Hi, I am fixing to get married, and I have a 2 and a half year son from a previous relationship. However his father doesn't have anything to do with him, he didn't even sign the birth certificate. We don't have the money for my to-be husband to adopt him just yet, however I'm wanting my son to have the same last name as my married name. How can I go about doing this in the state of Georgia. I am currently going the child support recovery and they are garnishing the fathers wages, and they have done a dna test, but like I said, he doesn't have anything to do with my child, we don't know where he lives or anything. Any help you can provide will be great. Thanks so much.

If he is on the hook for child support, he has a legal right to the child and therefor you must have his consent to get the child's name changed. If he is unreachable, there is a process that your lawyer can go through for notification and such. I would see a lawyer about it or save some money and just handle it all when you are ready to adopt.

You can call the child anything you want as long as your intent is not to deceive.
