Hello,
I am a citizen of India and currently on F1 OPT status and considered as a Non-resident for tax purposes.
I received 1099-G from ny state which reflected the 2007 tax refunds and also 1099-INT from my bank for an interest amt of $16.
I always used standard deduction since I've been here and as far as I know, I should not report both of these on my 1040NREZ. Correct?
Please help me as I've already filed the papers and I probably need to do a 1040X if I am wrong:)

You are correct that you do not report the 1099-G amount on your taxes, since you took the standard deduction for your 2007 taxes. However, 1099-INT reflects income you received in 2008, and so must be reported on line 8a of form 1040. I am assuming here that the $16 is reported in box 1 "Interest Income" of your 1099-INT and not box 8 "Tax-Exempt Interest" - is that correct? Unfortunately, you can not use 1040NR-EZ if you have reportable taxable interest like this, but must use 1040-NR instead.

On nonresident form you do not get standard deduction. You get itemized deduction. If you are from India, then the itemized deduction is equal to standard deduction.
If you took itemized deduction of state taxes in 2007, then 1099-G is income.
For Nonresidents bank interest is not taxable.

Thank you for the response. Mukat, you are correct that I am using Itemized deduction as Standard Deduction. This means that I should report 1099-G on line 4 in Form 1040NREZ?
Also, I am residing in State of DE and I am considered as a resident for tax purposes. Do I report 1099-G income and 1099-INT amount here as well?
This is so confusing. I really appreciate your help guys.

If you, as an Indian, claimed the standard deduction on your 2007 rreturn, you can completely ignore the Form 1099-G.
The $16 in interest on the Form 109-INT is NOT reported on Form 1040NR or 1040NR-EZ, as F-1 visa holders are EXEMPT from taxes on bank interest.
You DO report it on your Delaware return; however, if you failed to report the $16, the amount is SO small that the state of Delaware will probably not bother asking about it even if they did notice the omission.
