Hi, I have a question about my tax return:

In 2006-2007, I filed 1040 NR-EZ, but in 2008:

Jan-July F1 W2 From school

July-Dec F1 CPT W2 From a company

1099 Misc Box 3 $1740 for scholarship.

Subject to tax treaty.

Question is:

Can I file 1040 NR-EZ and put both W2 wages in line 3 and deduct $5000 tax treaty?

Where should I put box 3 income? Can I put it in line 5 scholarship grants since it is from 1099 MISC though it is scholarship? Or I need to file 1040 NR? Can I deduct this income because of tax treaty?

Because you got a Form 1099-MISC, you must file Form 1040NR. The 1099 income can be reported on Line #12 as "Other Income" because, as a student, you are NOT liable for sefl-employment tax and therefore completing Schedule C is not really needed.
