View Full Version : Status change from L1 to H1 in 2008 - How to file taxes?

1. I am married with 2 kids. I came to US with family (wife and kids) in May 2007 on L1A. I filed my taxes for 2007 as "married filing jointly". While filing taxes - the tax consultants (contracted by my company) had asked me details about my income in India including account balance in my India account. From the tax statement I can make out that the tax consultants increased my overall US income (though can't figure out how they arrived at the $ amount that was added to my W2 income) and also filled form 1116 to claim foreign income tax credit (again can't figure out how they arrived at the $ amount)

2. I resigned from my US employer and left US on 7th Jun 2008. I joined a different employer in India and returned on 7th Dec 2008 on H1B status alongwith family with the same employer. In between I travelled to US on B1 for approx 25 days

3. While in India, I earned income in India and paid taxes on that.

Questions:

A) Do I declare my India income while filing US tax return for 2008

B) If yes, How do I calculate the income in $'s to be added to amonunt shown in my W2 statement (I have 2 W2's with me - one from previous employer and one from new employer - but for same state)

C) How do I calculate the amount for which I should be getting Foreign Income Tax Credit

a) Yes
b) Complete Form 1116.
