View Full Version : Tuition tax credit for dependent daughter

While working on the 2008 taxes I am claiming my daughter as a dependent as she lived with us for more than six months before entering college fall 2008 as a junior. :) Can I qualify for the tuition tax credit using the 1098 T form she got from the University showing the $8900 tuition she paid. When filing her return Turbo tax would not let her claim that tuition credit presumebly because she was my dependent. It does not seem fair that neither of us can claim the tution tax credit. Any info would be appreciated.

You cannot take the tuition and fees deduction on your income tax return if your filing status is married filing separately, or if you are claimed as a dependent on someone else's return.
The deduction is reduced or eliminated if your modified adjusted gross income exceeds certain limits, based on your filing status. You cannot claim the tuition and fees deduction and a Hope or Lifetime Learning credit for the same student. If the educational expenses are also allowable as a business expense, the tuition and fees deduction may be claimed in conjunction with a business expense deduction, but the same expenses cannot be deducted twice.

If you are claiming your daughter as dependent, then you will take tuition and fee deduction. Dependent can not take Tuition and fee deduction.
