View Full Version : How to remove name off a deed?

There's no mortgage,the house is fully paid for. We're looking to sell it.The deed however has 2 names on it,the other person (former in-law) we have been unable to contact,and calls to her family members have gone unanswered and unreturned,letters also. We've been 6 months now trying to contact her to get the house sold. She has no phone listed.
How do you remove a name from a deed without the other person signing a quit claim?

Welcome to AMHD. I would hunt for this person and ask them to sign a quit claim deed. Tell them the home is in need of repairs. Otherwise, you may have to file a petition in your court of general jurisdiction and ask for authority to sell. This could be a huge mess if the other owner has judgement liens.

I have honestly tried everything I know how to do in terms of finding her,short of hiring a private investigator,which we really couldn't afford. She lives or lived,3 states away and we have not heard from her in close to 6 years. I explained the situation to her uncle,and now he doesn't answer the phone or call back when we call. I don't know what the deal is exactly,I do know that her uncle shorted his brother part of the inheritance when their parents died,but I really don't care about that,it's irrelavant to us,but maybe not to his daughter,we just need this taken care of and it's ridiculous that no one is answering me this long.
I have no problem giving her her half of the money when it's sold,but I can't sell it without her either being there to sign or signing a quit claim,the way I understand it. I guess I need to get on the stick about going to the title company and property app office and see about filing that petition. Thank you for your help!

Have you offered the unce money to help find them,
But yes short of the PI or an attorney to go to court, you are stuck.

I ended up having to get a lawyer to get the authority to sell,thank you.
I'm not about to offer the uncle money,he has millions and we're borderline broke,all he'd have to do is make a phone call or pass our number along.
But thank you again for all the help!
