View Full Version : OPT in New York City making sure I'm filing the right forms

Hello there,

This forum has been an incredible resource for the past few years. I went to school in two different states and this is the third year I refer to this website when it's time to file taxes.

I started my OPT in June 2008 and I've been working in New York for a total of six months in 2008. Before that, I worked on campus in Massachusetts (early part of 2008). So what I have in my hands is:

1 W2 from the school in Mass. With no medicare and social security taxes deducted
1 W2 from my current employer which erroneously deducted soc. Security and medicare taxes
1 1099-MISC from a company I freelanced for while on OPT

I am from Italy and I've been in the US for a little bit more than four years (it will be five years in summer 2009).

From what I understand, I need to file '1040NR + Schedule C' instead of 1040NR-EZ (which I filed for the past three years) because of the 1099-MISC I have. So in the end, what I'm going to mail to the IRS is:

1040NR + Schedule C
Form 8843 as usual
Form 843
Form 8316

Am I correct?

Your tax return is Form 1040NR + schedule C
And Form 8843 as usual.

Do not file Form 843 and 8316 with your tax return. It is filed separately. Your U.S. Tax Return: Social Security and Medicare (FICA) Taxes for Non-resident Exempt Individual (http://taxipay.blogspot.com/2008/03/non-resident-exempt-individual-social.html)
