View Full Version : My roomy has no job can I even proceed to evict?

Hi there. I need help. I think I'm stuck under California Law. Here's the situation. I own a home. I rent to 2 other individuals. One of which, makes me want to move out! And I own the place! So nutty...

So here's the dilemna, I'm wondering if it's even worth it to give a terminate a lease when, the individual that I'd like to move out is a student at school with no income, she's almost 30 years old and has never had a job in her life. Her parents pay for everything. See, I live in California and the law states that you cannot evict someone if they can claim hardship. So my question is... can this individual claim hardship thus allowing me to be stuck with her for what seems like forever? She pays $825 a month for rent and is getting a Phd.

Any help would be immensely appreciated. Any hope for having her leave the house would be even better!

You say she pays $825 in rent. Are you getting this money or did she stop paying? If she's still paying, what's your complaint?

I find it hard to believe that CA would require you to continue to provide space for someone who is indigent without some recourse. I suggest you contact a real estate attorney to get clarification on your rights and obligations here.
