I plead guilty to a misdemeanor theft in 2004, I received two years non reporting probation and paid restitution. I would like to start nursing school but you have to have a clean record. I live in Ohio in Clermont County and I want to file for expungement. Hamilton county sounds easy from there website you go there pay $50.00 and file, they review it , set a date for you to appear in court and make a decision to grant or not grant an expungement. I can't find any info on Clermont County courts and that is where I went to court and plead guilty. I also wanted to know once I do get my record expunged when I get fingerprinted for my nursing license will this conviction show up? Some one told me once that it only clears our local record not federal?

A full explungement will clear your record except :::
If it is for any law enforcement position it will show up.

If it is for any national security position it will show up

And normally the courts will want it to be 8 years after your punishment ended and you show a stable work and/or education since then

Thanks for your response. I was told when I pleaded quility to this charge that I could get it expunged a year after my probation ended. That was from my lawyer and a friend of mine how works for a judge. I guess I need to call the court and ask them what I need to do.

2953.32 Sealing of conviction record or bail forfeiture record.
(A)(1) Except as provided in section 2953.61 of the Revised Code, a first offender may apply to the sentencing court if convicted in this state, or to a court of common pleas if convicted in another state or in a federal court, for the sealing of the conviction record. Application may be made at the expiration of three years after the offender's final discharge if convicted of a felony, or at the expiration of one year after the offender's final discharge if convicted of a misdemeanor

This is what I just found and I am sure it is different for each state.

A first offender program ( if you were in that program though the court) is different, in it they allow for it to be explunged easier

In my view, when being considered for a state sponsored license, your conviction WILL show up.

I believe even an expungement will show up on a Licensing (or admissions) background check.

Yes, the Ohio State Board of Nursing has Federal level access to court records. You can have it sealed, it can't hurt. However, you must still disclose this, otherwise it will be look at dishonest. If the infraction is a MIV or MIII most hospitals will not take issue with it. However, some will. Many employers will not be able to see a sealed record, but, you picked a profession that the powers to be can.

HLS, anything Fed, and anything caring for people or working with children...

My wife disclosed her record to the OSBN, and her employers. The Mercy Hospitals and Children's Hospitals we OK with it. The University of Cincinnati Hospital was not. There is no clear cut answer here. There is a lot of "depends" going on.
