My children's father has no contact with them he hasn't seen the children for 3years we have been separated for 5years I have just started receiving £5 per week child support I have had 3 payments so far. My children wish to change their surname they are aged 11 and 9 where do we stand on this matter?

I assume you are in the UK, but in the states, it requires parental (both) consent. Is your ex willing to allow this?

I am in the uk, I don't speak to him at all there is no contact so I don't know whether he would agree to it

Can you speak to him? If you can get his consent, it is sure to be much easier.
