My marital settlement agreement states for my ex husband to pay child support. He has paid the child support directly to me. We did not set up through the state to have the support deducted from his check. As of September 2008 my ex husband has stopped paying child support. I went to the child support office in Georgia where I currently live and applied for services. I received a letter from my ex husband that he had moved to Canada. When I reported this to the child support office they told me that since I had no current address for him there was nothing that they could do, they were not a locator service. This does not seem correct. What appopriate action can I take to have my child support enforced.

I believe that your ex is now out of the jurisdiction having moved to Canada. If you could somehow locate his new address they might be willing to pursue your case. Had he simply moved within the US they could have located him if he worked on the books.

When child support is ordered, the court needs a person's social security number. I don't know what the law is in your state but in mine, which is Wisconsin, they automatically flag the payer's tax refund check for interception anytime they owe over $100. However, I don't know how or if this gets affected since he moved to Canada.

If you got a letter from him, didn't he put his return address on it? How old was the letter? You could try sending a certified letter to him, which would require his signature and would be proof of his residency.

Georgia has one of the toughest enforcement, but they have to know where he is. So if you find him and turn it over to them, they will enforce the order.
But very likely he is lying about being in Canada, if he is, he can be found though a visa to live there

Bottomline is you need to find him. Maybe relatives can help, but until you get an address, you are stuck.

IF he was still in the US, the enforcement agency might be able to check his current employment, but not in Canada.

If you are not getting anything, you may also consider some of the private collection groups, they work harder on "finding" since they get a percent of the collection
