View Full Version : Can I move h1 to f1 and in between I get the project so I will again move to f1 to h1

Hi this is andy here.

Right now I am in h1 of usa and for the knowledge purpose I want to move h1 to f1 and after finish my study of 4 month can I move f1 to h1 again easily?

Can please give some idea what is the exact procedure and law for changing status?

Yes, if you are in valid nonimmigrant status, and you qualify for the status you are changing to, you can file. Please note the only thing that may be tricky would be if you filed for a labor certification or other permanent resident application while you were an H-1B. This is fine for the H, but not good at all for the F-1. research "dual intent".

The COS to F-1 is usually done by the school as they issue the SEVIS I-20. Good luck!

Also, you will not need to be counted on that years new H-1B cap as you have already been counted on the previous filing. So no need to file April 1. you can file anytime.
