When I left my job I had some retirement coming so I opt to take cash, which wasn't very much, and pay my 2 credit cards. I did what they call a settlement. On one of my cards they did a settlement which I had about 350.00 left which they wrote off. She said I should be receiving something in the mail in a couple of months.When I didn't hear from them I call and they got real nasty with me and told me that the girl should have not done that etc, etc, etc. My sister( I was up at her house with my information) did a lot of the talking ( which I gave my permission) she is a much better talker than me. She is my witness. I even wrote a letter outlaying all that was done ( they have turn over to a collection agency) I want to know if they can sue my or garnish my check? I just don't understand any of this. I do not have the money. Before I forget I have been receiving bills each month and they are getting higher. I told the girl to cancel my card and I cut my card up when I got off the phone with her.

Unless you have some proof that they agreed to the settlement (you should never have made payment until you got the settlement in writing) they can sue you. If they win they can't garnish your social security but they may be able to garnish a private pension and they can attach your bank account.

However, if they do sue you, you can present whatever proof you have that they gave you a settlement offer and that you paid it in good faith.

Do you have anything to prove they offered a settlement? Also do you mean you owed certain amount (ex: $1000) and they agreed to take $350 less than that (so you paid ex: $650) and that was supposed to close the account?

Also you can't ask them to cancel the card until you have a 0 balance so they will keep adding interest. You need to prove they offered a settlement or pay the last $350 or whatever it is now..

You are the poster child of what we write here everyday, if you don't have it in writing first before you send them the money it never happened.
The collection people lie, all the time to get that payent since most make a commission off how much they can get you to pay.

So sadly your sister talking to them is really not proff, what should have happen, you get a letter to the agreement before you sent them the money.
