View Full Version : Moving to the USA from UK: US citizen and UK citizen

My husband is a UK citizen and I am a US citizen. We live in the UK and were married here about 5 years ago. I have indefinete leave to remain in the UK. We also have 3 young children now. We are wondering how we would go about moving to the US. Our children have British passports, but I know I can get them US passports at the Embassy. How would my husband be able to travel to the US with us if he doesn't have a job lined up yet? Thank you, Ruth

For your husband, you need to petition for him. Starts with the relative petition (I-130) and then the application for an immigrant visa. You will need to sign an affidavit of support showing your family income is 125% of the HHS poverty guideline for a family of 5(?). Check with the US embassy or consulate as you may be able to file the I-130 there rather than at the USCIS service center here in the US.

For the kids, did you register their birth (consular report of birth abroad) at the US embassy or consulate? If so, they are US citizens and can apply for US passports.
