View Full Version : My husband has a child support order but what about me and my kids

My husband has a child support order for a child he had before we got married and everything was good between them and child support before we got married. Now that the women knows he's married and we have a child she has taken him to court for a crazy amount of money. This will put a hardship on my family with her asking for 3x the amount of money they had agreed upon and he was paying. The courts don't seem to care that he has a family that will now suffer. What are my options?

Mind you my husband has been unemployed now for over 6months and they are basing the court order upon what he use to make. Stating that, that is the amount he has the potential to make when he finds a job.

What can I do to protect me and my child?

He has to go back to court and get a reduction order entered due to his current conditons. He can't just expect her to be nice about anything.

Without that reduction order he can and will be held for the arrears in the child support order.

By law the first "family" gets first dibs on the money earned, the second "family" basically gets what's left. It's not exactly that, but you get my drift. What does matter is what is court ordered.

I'm really sorry to hear about your situation. Has your husband contacted a lawyer about this? Maybe you should seek legal counsel if not. Most family lawyers offer a free consultation and thye can tell you if it would be worth trying to take the other woman back to court. I hope everything works out for you!

The child support is based upon income and/or lack of it for an min amount.

If for example, he was earning a lot more he should have been paying more but if not, he needs now to set up the correct payments
