I am 8 months pregnant and my sons father and I are already fighting over custody. What are the custody and visitation laws in NH for a newborn baby? I will be breastfeeding him and I don't think it's appropriate for him to sleep over his fathers house when he will be so young.:confused:

Welcome to AMHD. You are correct. But you should file a petition for custody and request a hearing as soon as possible. Otherwise, with no order of custody, he could take the child at will.

The law in NH, as it is in most of the US, is THE BEST INTERESTS OF THE CHILD.
Generally, judges will recognize the breastfeeding issue when determining visitation.
Do you know if the father has an attorney, because if he does and you don't, you will lose.
As soon as the baby is born you file in Family Court for Joint legal custody, but primary physical custody. Offer frequent visits in your home until the child is weaned, then allow for overnight visits. If you are reasonable and he is not, you stand a better chance.

File for legal separation or divorce, now; which ever suits your interests and your concern for the baby. The hearing can be scheduled after the birth.
