My daughter has gotten into a jam. She worked for a company and was taken money from them. When she quit they later found out. She talked to the owner and agreed to pay them back. The bank paid back majority of it. And when she had payment she would send it in. The company hasn't pressed charges. From my understanding they are having a lot of legal problems themselves with stealing from their customers and other illegel things. What is the worst that can happen to my daughter? We are trying to pay them off but it is very hard to do so at this moment. We have a written agreement to pay them back. Can she get in trouble for the three payments that she has missed?

Yes, she sure can get in trouble as you put it. The company can go to the DA and press charges against her for the embezzlement of the funds. Depending on the amount of funds taken, it can be a Third Degree Felony punishable by 18 months in jail in some states.

If you don't live in Canada, the store lost its opportunity to file CRIMINAL charges against her when it entered into the repayment agreement with her.

The agreement, while BINDING on your daughter, is a simple promissory note. The only remedy the store has, should she not pay, is to file a lawsuit. She can't be charged with a criminal offense.

If the store threatens to charge her criminally, should she not pay, then they're guilty of extortion, and they can be prosecuted.
