View Full Version : How much notice do need to give before moving out with an expired lease?

I have been renting an apartment for 2.5 years now in Florida. Each of the first two full years I signed one year leases.

However, the last lease has expired and I have been renting the last half year with out any signed lease.

My question is, how much notice do I need to give my landlord before I move out? Keep in mind as well I do not want to forfeit my deposits.

I have looked up the Florida Lease Laws and from my interpretation of them, I believe I need to give the landlord 15 days written notice (I assume then I am under a "verbal month to month" deal?).

Can anyone confirm lead me in the write direction.

Thanks.

Hello goose:

Without a lease, you're a month to month tenant. MY understanding of what that means, is that either of you need to give the other at least a 30 day notice for any changes...

The worst that can happen is you gave it too soon. Do it in writing, sent certified, return receipt requested.

You are correct.

On a month to month tenancy in Florida, either party may terminate the tenancy with a written 15 day notice.

Hello again:

I don't doubt that 15 days is legally sufficient... But Florida must have dropped into the ocean...

In the REAL world, a working family will NEVER be able to find a new dwelling and vacate a premises in 15 days - NEVER.

Florida is setting up its landlords and tenants for failure... Our laws ain't supposed to do that!! They're supposed to do just the opposite.

Maybe the sunshine bakes your brain.
