View Full Version : If she objects, do you think she will get custody?

I am in the military and I have custody of my two girls. The mother didn't have parenting time or any visitation. I let her see the girls after her being away for 2 1/2 years. I felt that she had not changed and that I didn't want her to see the girls. I had a no contact order put on her in SEPT 2008 and she filed paperwork for visitation in Jan 09. The judge said since I allowed her visitation that he would allow it with supervision. Problem: I am slated to transfer on May 01 09 and I am concerned about the Judge giving her custody. Once I file the Notice of Intended Relocation, I know that she will object to it. Have you seen a case where the children are not allowed to relocate? They have not spent a lot of time with her and I have been taking care of them for well over 3 1/2 years and she has not been around.

It all depends on what the judge feels is in the children's best interest. If you have to relocate due to work and you've been their primary caregiver, he may allow you to take them with you. However, he may not think it's in the children's best interest to be uprooted. At this point, it's hard to say what will happen.
