In a case where a child's parents are divorced, but share joint legal custody, do both parents have to sign off when a disabled child is moved from one school to another?
Here is some background: My step son is 11-years old. He has autism and has been attending a private school since he started school. Recently, my husband found out that Mom had decided to change schools. She never contacted Dad (or the current school) about this process, instead he found out from a social worker who, new on the job, thought it would be prudent to contact Dad. The same social worker informed Dad that his permission or approval was not necessary for the change to be made. Does anyone know if this is true? Legally, Mom and Dad share joint custody.
