Hi

In 2008 I had lived in US on H1B Visa for 287 Days.
My wife was in H4 and she lived for 223 Days in US

Both qualify for Resident alien status for the year 2008.

We are now back to India after my job was completed. My income is only from employment and I got the W2 form recently. I have following questions

1. Is it sufficient that I fill the form 1040EZ along with W7(For ITIN for my wife) and copy of W2 and send it to AUSTIN address.

2. What address do I need to put in the forms? International address or local employer's address

3. Can I do an e-file after getting ITIN for my wife?

3. Another question is I lived in NY state whereas salary was processed in NJ. Which state return I need to file ?

Your suggestions will be highly appreciated.

You will file resident return or dual status return will depend on the dates you entered the U.S. and left the U.S.

1. Correct if you qualify for resident return.
2. you can give your India address. If you have a refund, IRS will send you check.
3. You will attach W7 with your tax return. If you file W7 separately, it will be rejected.
4. You will certainly file NY return. If you worked in NJ, then you will also file NJ return.
