My friend was on probation but was arrested on a warrant for child support, meaning he has a probation violation.when being arrested, the police found a firearm, though it did not belong to him.it belonged to the other friend who was driving the car.the police charged my friend for that.he has a court date coming up.what can I do to make sure that he at least gets house arrest, work release and community service or something rather than being put in prison?according to his PO, he has been very compliant and has followed everything that the PO told him... he did not do anything wrong... apart from being at the wrong place.can anybody pliz help me out

Only the Judge at his VOP hearing will decide his fate. The gun charge is not going to be easy to dismiss. He really needs to get an attorney to help him on this one.

If the firearm was not secured, and within reach of him, he is guilty, does not matter who it belongs to.
Just being in a car with a firearm is all it takes.

So he needs a serioius attorney now.
I know someone who is doing 5 years in Federal Prison right now for merely having a firearm and being a felon.
Did not matter who owned gun ( it was someone elses) just the fact he had access to it, was all they had to prove in court.
