View Full Version : Can a man who is not the father of your child adopt them?

My sister has a 5 year old daughter and does not know who the father is, she is now dating a guy and they plan to get married and he wants to adopt her daughter. Is it possible if there is no father listed on the birth certificate? :confused:

I am not an attorney, but what I know of this process is if the father never signed the birth certificate, is not involved in the child's life what so ever and the mother gives consent for adoption (in this case of course, she is), I see no reason why he couldn't file the paperwork to adopt the little girl as his own. This might also depend on where your sister is from. Laws may vary. There is of course a gigantic legal process in the court system to adopt, so consulting and hiring an attorney is a must in this case.

She needs to get an attorney.

There MUST be an attempt to contact the biological father, or he could turn up one day and overturn the adoption.

A family law attorney would know what specific steps she has to take in order to have her HUSBAND (yes, they probably need to be married first) adopt her child.
