Hi,

Sorry if this has already been asked. Some information about me:

Current Visa: H1-b (Effective October, 2008)
Previous Visa: F-1 (Aug 2005 - Oct 2008)

Based on my search, I think I need to file 1040NREZ and 8843. I do have a question about the social security and medicare tax withheld in 2008 after my visa status changed to H1-b. The 1040NR forms do not have a line item for SS and medicare taxes withheld. Is there a way to get a refund for those taxes?

On your H1-B income you must pay SS tax and Medicare tax.

Do I still use only 1040NR-EZ, 540NR and 8843? Should I use the first year choice?

First Year Choice for a single person allow him to file as a dual-status alien. More than likely, this has NO TAX ADVANTAGE to you, and you have to wait until 1 June 2009 to file.

Better to file as a non-resident alien and file immediately.

If you are married, you can file jointly with your spouse and you BOTH choose to be treated as resident aliens.
