I just laid off after 11 months of working. My question is they gave me a relocation package at the beginning of my career which is still valid and I can use it. I asked them to give the penalty of my leased car from that money ( it is part of the policy) but they didn't accept.

They gave me in total 6 months as compensation due to my job band... however I still think its fair to let me use my relocation money as well. Since I could have been used it all by now (I used only 400$ and 9600$ is sitting there).

I don't want any cash from it and I just want to pay my lease penalty and sell my car.

There was a penalty on my contract in which if I leave company I should pay back much money... but there is no penalty for them to lay off me that soon without any reason?

The compensation they gave me is standard everywhere.

Can I sue them ? I can't sell my car now... and I can''t afford it anymore..

Well first a 6 months package at lay off is far from standard, perhaps in your specific industry but normal lay off is good bye and a hand shake.

Moving and/or relocation expense is or was to be used for actual moving, so did you move, did you turn in temp living bills did you turn in a moving company bill, I would assume not.

That money from my understanding of its usage commonly is not merely a savings account for you to use as you wish, and it would have terminated when you were laid off.

The fact is, if you did not use it to move,

So legally
1. no the relocation money is not yours to use for anything but to relocate to the new job, if not used for that purpose it would merely go back to the company.

2. your car you got 6 months salary, so keep the car for 6 months and find a new job by then?

3. can not even dream of a reason you believe you have a case against the, and in today's job market, that will be a great job reference , he sued us after we laid him off with 6 months pay. You could basically kiss any career ever good bye.
