View Full Version : How can I have my child support order dismissed?

Hi,
I live in NJ and have a child support order in place since 1985. I was 17 yrs old at the time , had no representation in court at the time of the hearing, I've never seen the child, who is now 24, and she doesn't have my name. I am married with 2 small children and I feel that maybe now it's time to end this. I have never had any contact with her or the mother inall these 24 yrs. My license has been suspended over this . Is there a time limit on how long the court can hold this? Also, as I mentioned, I live in NJ, but they come from Penn. If that makes a difference.

I'm not sure what your question is. If your daughter is 24, then you shouldn't be paying support any longer. You then say that your license is suspended; when was it suspended? Do you have any support arrears? Even though your daughter is an adult, arrears still need to be paid as they were ordered to be by the court.

The child support order will have ended either when the child turned 18 or for college if it was part of the support order.
So there is no current moneys due.
If you were not paying the monthly amount required, they will have to be paid to clear up your drivers license, and perhaps to keep you from going to jail. Also having unpaid support, can stop you from getting many jobs today.
But over the 18 years you had full rights to go back to court and get the child support amount modified to your current income. So all you need to do is pay what you owe to end it.

Reading between the lines here, it sounds like you were listed as the father of a child and a support order issued against you, but that you have never paid on that order.
If that's the case, then you will probably be required to pay the arrears. Its probably too late to fight paternity.

If I am reading this correctly you lost your license for non-payment of support. It will not be reinstated until you pay that back support. It never expires and CAN, in some States, turn into a Warrant. I'm surprised you aren't being actively pursued by the Courts (unless they can't find you).
