I live in another country (Thailand) and my son lives in Indiana where the agreement of paying child support was made with the court. My son will be 21 in just a few months, he has his own child, he is in the Reserves and has been for almost two years. I believe he still lives at home with his mother. Can I stop paying child support and if so... what do I do.. do I just not send anymore checks or do I have to get permission from the state of Indiana before I stop. I would greatly appreciate it if someone could answer this question. :)

I would say that you may have been able to stop paying a few years ago.
Unless he is in college view states have support over 18. And most do not even have laws for going to college.
Your child support / custody agreement should be the one that tells you your rights.
I would pay an attorney in Indiana to review your custody agreement before I made any additional payments

This should have been spelled out in your support order. Do you have a copy? I suggest reading it carefully.

Fr_Chuck is right.
I can add this thought though, as soon as he entered into the Guard, he was no longer classified as a dependent from a taxation standpoint, regardless of educational situation. This may become an issue for him and his mother if she is still claiming him as a dependent on her taxes.

What we have to remember here is that Indiana was one of those flip flop states that went between 18 and 21. So lets just say for argument it actually is 21. At this time you need to contact the person or agencie that your paying supprot to. Now is the time so when it does end it ends legally. You shouldn't need a court order to stop it. But you do need to notify the payee its going to stop so they can get prepared rather then shocked. Also if your paying through an agency let then know and any collections for child support should end.

If that's what the agreement says, then you have to go back to the court to request it be ended. If he is emancipated you can prove that and request support be ended.
