I have custody of my daughter. I am the dad. My name was never on brth certificate- mom has to add it. Cannot locate mom. Cannot change her name until I am on birth certificate. Have paternity test on file. Is there anyway around this?

If you have had a court ordered paternity test you are the legal father and getting the B/C fixed should be a simple matter. Have you called the court to ask them how to do this?
As for the name change, without the mother's consent, you will probably need a lawyer to go through the process of doing it without consent.

A person can use any name they want as long as there is no intent to defraud. So your daughter can start using your name anytime she or you wants.
She may have to use her legal name in certain circumstances, though.
If the courts have declared you the legal father and you have full custody, it shouldn't be a problem to have the because changed.
