How much time do we have to respond to motion for summary Judgement?

Hello Robert:

It probably says right on the piece of paper. If not, I wouldn't wait. Of course, you've ignored notices from the court already...

It depends upon the rules of civil procedure for the particular court in which the motion was filed. For example, my jurisdiction, which has adopted a version of the Federal Rules of Civil Procedure, allows 15 days, plus an additional 3 days if the motion was mailed to you (they usually are), for a total of 18 days from the date of mailing.

So, using that jurisdiction as an example, assuming the motion was mailed on July 30th, received by OP on August 2, OP would have until today, August 17th to file an opposition. If as you suggest, the motion was mailed 5 years earlier than that, the court has probably already been ruled upon.

No, usually it doesn't.

I saw '06 (before I posted). But I used the date, not the year, as an example.

It's all CW77's fault. ;)
