I want my fiancé to (and he wants to also) adopt my 11 month old child. He is all she knows as a father figure, her real father gave up on her about 9 months ago, haven't heard from him or seen a dime since. I know this can be done, but my hang up is that I am still married to my child's father. I have been trying to divorce him for 15 months now and he won't agree to anything I offer. We are NOT fighting about custody, I think he is just trying to make my life a living hell. I know he probabally would do the same if I asked him to give up his rights. He has essentailly abandoned her, does not call to see her, does not financially support her AT ALL. Can my fiancé adopt her without my (hopefully soon to be ex) husband's consent?

Nope. Absolutely not.

And in most states, he can't adopt her until you're married, either.

You CAN NOT start adoption proceedings without consent of the biological father, unless you can prove that he is a danger to the child and can get his parental rights taken away. Not very likely without proof of abuse--either of the child or of substances.
