Collection Agency refuses to let me make payments

--------------------------------------------------------------------------------

I am a breast cancer survivor attempting to pay a debt that got behind when I was ill. I made payments every month, but not always the minimum, and when the minimum was not paid, it was considered late and tagged with associated fees. It is a Sears account.

Sears refused to work out a monthly payment plan and sent to collection. I agree the debt is mine and I want to pay it but can only afford a modest monthly amount. The collection agency says I must pay in full within 24 hours or they will place a lien on my home and bank account, and garnish my wages.

Isn't there a federal or state law that forces them to work with me and set up payments I can afford? Please help!

No, there is no law, in fact the law is they don't have to accept less than full if you are in default.

Not sure "how much you can pay" but if it is less than the min paymnet used to be, it is possible it may be less than just the interest for the month.

Now they can not put a lien or garnish you pay without first taking you to court and getting a judgement.

And they normally will attach your bank accouints and garnish your pay first before they go after a lien.
