View Full Version : Getting probation switched from one state to another.

I'm 19 and I haven't been in trouble before. I have to go to court jan. 20... and it will be the first time I have been to court.. I think all they are going to do is ask me if I'm guilty of the 6lbs. Of marijuana charge, and ask me if I need a lawyer. This happened in Tennessee and I moved to Alabama, with my fiancé, after all that happened, and she helped me get signed up for my g.e.d classes and I got my g.e.d. and now I am looking for a job. I planned on going to this college down here in the fall. My question is, " do you think when I get put on probation if they will let me switch down here to Alabama? I feel like its better for me down here anyway cause I didn't ever accomplish anything in Tennessee.. and I feel like I'm getting a lot accomplished down in Alabama with my fiancé. I got my g.e.d and she and I are suppose to be going into the medical field together.

How long ago were you arrested?

Only the Court knows what it's going to do. People have posted that Probation required them to live on their own, not with family, not with a girlfriend. They don't want to take the chance that the two of you break up and you have nowhere to go.

I would get an Attorney - fast - if that isn't a misprint and it actually was 6 pounds. What was the charge - intent to sell?

Why do you think you are going to get probation. This is from the TN website: "It is a Class C Felony, punishable by 3 to 15 years imprisonment and a maximum fine of $100,000 for a Schedule VI drug offense involving: ... (A) not less than four pounds (4 lbs.) of marijuana."

The sentence jumps to 25 years if it's over 10 pounds.

Sorry 6 pounds, don't get too excieted expecting probation in Tennessee, and esp if this was in a small county.

You need an attorney fast, and expect to have a lot of hearings and court dates before this is over.

If you have not had a first hearing ( unless you waived your rights to one) you will get your rights read to you, and you will be asked to make a plea.
Also in TN, if you have posted bail, normally you can not have a public defender, since they figure if you can afford bail, you can afford an attorney.

Possession of 6 pounds is a serious felony in TN First offense, I would expect a 5 year sentence and out in 3 but that is my guess.

I agree. Probation does not look to be in your future in Tennessee with 6 pounds. You should look to getting an attorney immediately and jail time or prison time of several years is more likely the future scenerio here for you.

OK thank you aLL for your input.also there is something I forgot to add. Well I was with 2 other guys and one of the guys was getting 5 lbs. the other, nothing. So therefore I only claimed one which is truthfully what I was getting.Now the other 2 guys claimed nothing and have hired attorneys.I cannot afford one so I'm stuck with a court appointed lawyer or "public defender" said the judge.
I'm just trying to get an ideal of what might happen to me.

Well, I think you'll get probation. If you want it transferred, you're going to need a job and a place to live before you get transferred...

Ok, one guy was getting 5 and you just one, bet they charge you all for the 6 lbs or try to anyway

Now the reason why I'm even entertaining the thought to tell you this. 1 your first offence and I hate when people don't know what their talking about a hired lawyer is always smart but when you can't afford to pay! 2 step your life depends on how you make yourself to become educated with your charge if you are smart enough to get g.e.d. than get the law sentencing guide line book read help yourself understand the law guide lines. You will not get the time you think,this method is used to scare the **** out of you and make you roll-snitch!! You never want to be marked that man up my estimate 5yrs probation restatution don't listen to people who think they know the law read be smart good luck peace

Remember the prison system is full they will not give you 15yrs or 5yrs fist time offender they will put their hooks in you if you get probation and violate!!

Was this "court appointed lawyer or" PD the one who told you you were going to get probation for 6 pounds? Maybe, if they buy your story that you were only "getting" one. But I'm curious: are you saying that the three of you, together, bought the 6 pounds? And you were arrested before you split it up? I don't know: "constructive possession" can turn that scenario into the three of you having all of it. :eek:

I hope, for your sake, that what you are saying is that you're lawyer has already made the probation plea bargain for you.

For one obviously none of these people have been to jail bud you can live with family you can live with anyone if you are doing all the stuff your suppose to believe me I went to jail on 2 felonys and I have been living with my grandmother and yes you can transfer because I was busted in TN too... and I had mine moved to wv these people are retarded
