View Full Version : How can I get custody of my son after a wrongful order has been set?

I have a 6 yr old son, We lived in Illinois, my father passed away in nov of 07, and I went to Alabama to see my grandfather, I left my son with his father in Illinois while I went. When I returned the father had started a petition against me saying I hadn't had anything to do with my son since he was 8 months old. Well because of this petition I couldn't get my son from him until we went to court. Well we went to court in dec of 08 and he had a bunch of people to testify to his lies against me and I had 3 people. Well the judge sided with him and I only get him one weekend a month and on holidays and the summer. What I need help with is finding some organization that can help me get my son back. The father doesn't even have anything to do with him, its his parents raising him. This isn't right, I'm not an unfit mother and have not been found unfit, I don't understand how he was taken away from me in the first place. Also we were never married. I really don't think there is anything you can do I tried for years to get my sons back but it is really impossible.
One thing you might be able to do is get school and doctor records and a letter from them stating he lived with you and you were the one that was always responsible to get them to school and appointments.

Have you spoken with a lawyer? It is possible that the court would allow someone from CPS to investigate and perhaps interview your child. Your child is old enough to know the difference between truth and lies.

If CPS sides with you, not only will the court likely overturn its ruling, but may prosecute the father for purjury.

Bottom line: speak with a lawyer who specializes in family law.
