I have a 78 year old Great Uncle who lives in a property owned by my father. He has never paid any rent, but only pays 23 pounds a month towards the council rates and for his utilities. My father who has just turned 70, has recently had a stroke and needs the funds from the sale of this property to fund a move to a retirement village. My Great-Uncle has said that he will not move. There have never been any documents drawn up in regards to his staying at the property, but he has been in the house since he was 11, when he was taken in by my grand-parents after his mother died. It has been explained to him by my brother and sister as to why the property has to be sold. Also he spends minimal time at the property, choosing to spend most of the day and some evenings at another house. What can we legally do to move him out. Our father is our sole priority at this time.

I don't know England's laws but are you wanting to get him out before the house is sold?

We want to either sell the property with him as a tenant (where he will have to start paying rent) or move him out first.
