My neighbour's tree is coming across in my yard and I would like to kill it. Try pouring diesel around the roots but that did not work. Guess because the roots were too deep.

Why are you killing someone else's tree? Why not just ask the neighbor to trim it back - or trim it back yourself?

I'm sure you're aware that if you kill it (and trees take a relatively long time to die) and it falls and anyone finds out you are liable.

Where I am in PA, law states that I have the right to trim back any branches that impede on my property line. But in no state can you legally kill a tree that is not on your property, especially if it's on the states protected tree list... huge fines, possibly jail time for that... Now, having said my disclamer... I don't think we are allowed to give advice about something illegal here... So, I'll point you to "google" your question... You'll find many answers there.
