View Full Version : H-1B minimum salary based on proposed I-129 or certified LCA?

For many cases, the employers specify different wages in the proposed I-129 application and the certified LCA. (The proposed I-129 has a higher wage/rate)

In such cases: what salary does the employer have to pay at a minimum to his H-1B employee:

1. Rate of Pay specified in the certified LCA or

2. Wage specified in the I-129 petition (Part 5, field: Yes, Wages per week or per year)

Compensation should be the one on I-129..

So, if the employer moves the employee to a different geographic location within US (different state), he will still have to pay what was proposed in I-129?
