Hello!
I got into a car accident in August 2006. I was making a left hand turn at a major intersection onto a one-way street. It was quite busy and of the two the oncoming traffic lanes, the middle had stopped because of the amount of cars ahead. I was waved through, the far lane looked clear and I began to make my turn. A small pickup truck came through the intersection last minute and I hit him. The impact caused my car to turn around in the other direction. The other driver suffered minor injuries and was sent to the hospital. His truck was in bad shape. I was driving a TJ. Anyway, I paid the collision deductable and it was seen as my fault and I was given a ticket for making an "unsafe move." My insurance monitored the guy for a year and advised me to notify them if I receive anything from him or a lawyer. I was updated that they last heard he was doing fine and my file was closed a year after the accident. Today I received a Statement of Claim. Today is January 8th, 2009. The Statement of Claim is dated July 22nd, 2008. Shouldn't I have received this sooner? I didn't move and I'm still at the same address. Also, why did it take so long? The things he claims to be going through he would have experienced within that first year: headaches, neck pain, back pain, elbow pain, shoulder pain, restricted range of movement, loss of job, an impairment of a serious physical, mental, or psychological function, and out-of-the-pocket expenses. He's looking for damages of $500,000, pre-judgement interest, and the costs of this action. I don't know what to do. I'm going to inform my insurance although I'm not sure what they can do and call a lawyer. Any advice for this would be great.
